On November 24, 2022 the BC Government passed Bill 44 – 2022 Building and Strata Statutes Amendment Act. When does Bill 44 come into effect?
Bill 44 – 2022 Building and Strata Statutes Amendment Act was passed on November 24, 2022 and came into effect immediately.
Will any strata corporations be allowed to enforce bylaws that prohibit rentals?
Bill 44 means strata corporations can no longer enforce rental restriction bylaws.
Does that include short term rentals like airbnb?
No. A strata corporation or section can still create a bylaw banning or limiting short term rentals.
Are any age restrictions still allowed in strata buildings?
Age restrictions in strata buildings are no longer allowed for ages under 55, and these bylaws are no longer valid. The only age restriction bylaws that strata corporations and sections are allowed are those that require one or more persons residing in the strata to be 55+.
In a building with a 55+ bylaw, is that building now allowed to have rentals as well?
Bill 44 means age restriction bylaws are now only allowed if they apply to 55+. Bylaws that require one or more persons residing in the strata lot to have reached the age of 55+ years are still allowed. Strata corporations can no longer enforce rental restriction bylaws, but they can still create a bylaw banning or limiting short term rentals.
If one of my parents live in a 55+ strata are they allowed to have a live-in caregiver or support staff living with them?
Yes. If your parent lives in a 55+ strata and is dependent on live-in caregivers or support due to disability, illness or frailty, they are allowed to have live-in caregiver support.
